As of July 31, 2026, Texas enforces a strict ban on most hemp-derived intoxicating cannabinoids like Delta-8, Delta-10, and THCP, making possession of these products a state jail felony

What is Banned

• Delta-8, Delta-10, and THCP: Manufactured or synthetic hemp-derived intoxicating compounds are classified as Schedule I controlled substances. 

• Penalties: Possessing newly prohibited THC variants can result in state jail felony charges, carrying up to two years in prison and a $10,000 fine.

• Vapes: E-cigarettes and vape pens containing cannabinoids remain prohibited under prior state restrictions.

What is Still Legal

• Low-Dose Delta-9: Edibles, drinks, and tinctures containing Delta-9 THC remain legal as long as the concentration does not exceed 0.3% on a dry-weight basis.

• CBD: Non-intoxicating, compliant CBD products are unaffected by the recent enforcement.
